Appeal Court Suppresses ex-Gov Nyako's Impeachment

   

The Federal Court of Appeal, Adamawa State has nullified the impeachment of former Governor Murtala Nyako.

 

The court said that the impeachment of the former governor was a misuse of the powers and privileges of the legislature and declaring the impeachment as null, void and of no effect.

In a unanimous judgment, the five Judges led by Justice Jumai Hannatu Sankey condemned the impeachment of Nyako by some members of the state House of Assembly as they described the lawmakers’ action as a gross abuse of legislative powers.

As the Judges put it, “Nyako’s impeachment as a high level of impunity, recklessness, rascality and a constituted gross of legislative powers by the Adamawa State House of Assembly.

The verdict noted that the gross abuse of the legislative powers by the lawmakers was borne out of their selfish motives.

Justice Tunde Awotoye while delivering his judgment, noted that the respondents took laws into their hands as they flagrantly abused the constitution of the Federal Republic of Nigeria to meet their whimsical and selfish desires.

Justice Jumai Hannatu Sankey, in her lead judgment noted the court as the last arbiter would not fold its arms and watch impunity being entrenched in the country.

She noted that the decison of the House of Assembly to ignore the constitutional provision of personal service of impeachment notice on the former governor was a misnomer to the constitution which must be uprooted.

The court ordered that Nyako be accorded all rights of the office of the governor of Adamawa State throughout his legally recognized period in office even as the court struck out the appeal of Nyako to be returned as governor of the state, as according to the court, the tenure of Nyako as governor had elapsed.

The court condemned in strong terms the arrogance of the lawmakers and some politicians who flagrantly refused to obey court orders stopping them from going ahead with the impeachment process despite the order of the high court in Adamawa State.

Governor Nyako was impeached by the Adamawa State House of Assembly on Tuesday July 16, 2014 following allegations of gross misconduct leveled against him by the House of Assembly. Jauro, Biobele Abraham Georgewill and O.A. Ogakwu.

The five time World Player of the Year is reported to be receiving lithotripsy, a procedure involving ultrasound shock waves to break down problem kidney stones.
"The surgery normally lasts between three quarters of an hour and an hour with the patient requiring sedation or in some cases anaesthesia," the Mundo Deportivo newspaper reported.
Messi suffered renal colic, a problem commonly caused by kidney stones, in Japan in December forcing him to miss eventual winners Barcelona's semifinal against China's Guangzhou Evergrande.

Klopp Glad With Sturridge Return

 Jurgen Klopp has taken solace from the loss to West Ham in the FA cup, in the return of Daniel Sturridge to the team.

Sturridge came off the bench on the hour mark against West Ham, and even though he lacked his usual killer instincts, he was a genuine threat.

Even though the game ended in a loss for the Reds, Klopp was happy to welcome Coutinho and Sturridge back to the team.

When asked whether Sturridge would be in contention to start against Aston Villa on Sunday, the German said: “We have to talk first with Daniel, the doctor and all of the medical staff before I make a decision about this.”
The game was a little bit longer than I thought because I thought we could decide it after 90 minutes, but we didn’t so it was [another] 30 minutes plus. We will see.

“It was great [to have Sturridge back], everybody saw it. Origi is back, Coutinho is back, so that’s good, but we need consistency in the line-up.”

About 800,000 people in Nigeria are currently undergoing treatment on HIV/AIDS case, the Executive Director of United Nations Programme on HIV/AIDS, UNAIDS has said.
He said this while his team paid courtesy call on the Vice President, Professor Yemi Osinbajo on Tuesday.
Sidibe said, “Already there is a decline in new HIV infections in the country, there is about 800,000 people in the country that are undergoing treatment.

According to him, ending HIV infection in Nigeria will send a positive message across the world.
However, Sidibe noted that there are still 50,000 babies born yearly in the country with HIV infection, a situation he described as unnecessary.
Reacting, Osinbajo said that access to healthcare is “a poverty issue, and must be put in that perspective.
He explained that it was for the same reasons that the Buhari administration put the “half a trillion Naira in the 2016 budget, the largest single budgetary item of any government ever on social investments programmes," that address poverty.
The Vice President was referring to the 6 social investment plans of the Buhari presidency which are:
*Creation of 500,000 teaching jobs for unemployed graduates
*370,000 youths to be taken through vocational training and skills acquisition and would be paid while doing so
*Conditional Cash Transfer programme where one million extremely poor Nigerians would be paid N5000 per month in 2016
*Homegrown School Feeding programme where the federal government provides one-meal-a-day to primary school pupils across the country
*Free Education for tertiary education students in Science, Technology, Engineering and Mathematics
*A one-time N60,000 loan to market women, artisans and traders through a Micro Credit scheme using the Bank of Industry.
All the programmes have been provided for in the 2016 budget, the Vice President restated, and they are means of reducing poverty and vulnerabilities. He stated that access to treatment by patients of HIV/AIDS as in other diseases is an equality issue “because the vast majority of people who need help are those who can’t afford it.”
He said the federal government will ramp up funding for healthcare in the country and work with the UN to eliminate Mother-to-Child transmission of HIV/AIDS, expanding treatment for patients and spurring local manufacture of the Anti retroviral drugs, the three major issues the UNAIDS director tabled before him at the meeting.

Budget 2016 Contains Too Many Errors And Can’t Be Passed – National Assembly

 The two chambers of the Nigerian bi-cameral legislature, the Senate and the House of Representatives, have on Tuesday, February 9, declared that the 2016 budget was full of errors, adding that the document could no longer be passed on February 25 as earlier promised.

This new development was made known‎ at a joint press conference chaired by Sen. Danjuma Goje, Chairman of the Senate Committee on Appropriation and Abdulmumin Jibrin, Chairman House of Representatives Committee on Appropriation in Abuja.

They argued that the 2016 budget contained so many discrepancies in figures as the initial date for passage was shelved indefinitely.

Senator Goje noted that the Presidency had also admitted that there were errors in the budget, explaining that it would be inappropriate to give a new date now due to the errors that they would have to work on.

He said: “We are here in connection with the ongoing processing of the 2016 Budget because these two committees are the ones saddled with the production of the final copies of the budget that would be passed by the National Assembly for onward submission to Mr President for his assent and subsequent implementation.
“We want to remove all ambiguities, we want to remove all paddings. We want to produce a budget that is in line with the constitutional provision. During the budget defence, a lot of issues based on the padding of the budget, arising from over-bloated overheads and in some instances cases of over-bloated personnel cost.
“But generally, there has been a lot of issues. The appropriation committee would look at these issues after the whole budget defence and do a very thorough work aimed at doing a proper clean-up of the budget.
“So in summary, the time-table for passage of the budget is no longer realistic because as appropriation committees of both chambers of the National Assembly, we need additional time to do a thorough job for the 2016 budget.”

Similarly, the House Chairman on Appropriation Committee, Abdulmumin, agreed that the two committees would have to do a proper clean up of the budget.

He said: “So we can pass a budget that is implementable and also acceptable to Nigerians. It is no longer realistic because we need sufficient time to pass a comprehensive budget.
“The President is an individual, the budget runs in thousands of pages, the President will not be able to go through it page by page.”
