Standup9ja: Rivers re-run- Court declares police panel
illegal
An Abuja Federal High Court has declared the panel of
inquiry constituted by the Inspector General of Police (IGP), Ibrahim Idris
over the December, 2016 Rivers legislative re-run election as illegal.
Justice Gabriel Kolawole yesterday ruled that the Special
Joint Investigation Panel, comprising the State Security Service set up by the
IGP was unknown to law and is contrary to the provisions of Section 214, 215 of
the 1999 Constitution.
“It is not only unknown to Nigerian criminal justice system,
it remains a contraption, whose questionable existence will put great legal
doubt on its report as a legal document,” he said.
Governor Nyesom Wike had filed the suit challenging the
panel by the IGP, which was communicated to him through a letter titled:
‘Investigation into allegations of crimes committed during the last rerun
elections in Rivers State.’
Wike, through his counsel, Mike Ozekhome (SAN), had asked
the court to restrain the IGP from conducting the probe.
But the judge held that under Section 4 of Police Act, the
police have powers to investigate any matter of insecurity in any part of the
country.
